Adjudication is a form of ADR and most commonly used in construction disputes. It is usually a cheaper and quicker way of resolving a dispute without reverting to Court Proceedings. Adjudication is a statutory right which the parties cannot contract out of. A party to a construction contract may refer a dispute to adjudication at any time. The adjudicators’ decision is binding on the parties.
