Sullivans Successful again in High Court Rome II Action

At the High Court in London last week before Master Yoxall in the claim of Ms Lyudmyla Malevych (1) and Mstr Anton Malevych (by his mother and Litigation Friend, Ms Lyudmyla Malevych) (2) -v- Saulius Mikalauskas (1) and Balcia Insurance SE (2), Sullivans Solicitors were successful in arguing that, in a substantial fatal accident claim that occurred in Poland where Article 4 Regulation EC 864/2007 (“Rome II”) applies, Polish law should be the applicable law.

The finding will lead to significant savings to Insurers and Sullivans were also successful in having their legal costs awarded in their favour.
